With all of the talk centered on the stimulus bill, I haven’t heard a lot of new information worth passing on concerning the estate tax. However, it is worth noting that H. R. 436, the Certain Estate Tax Relief Act of 2009,  has reached the Ways and Means Committee.

The target of the first tax increase of the Obama era is (as predicted) the estate tax. It is not surprising that the estate tax will see the first tax increase, after all candidate Obama promised to freeze it at 2009 levels. However, it is interesting that this tax increase is such a high priority that it is getting attention before he officially takes office. You made it! The Federal Estate Tax exemption is now $3.5 million; however, before you get too excited please remember that the Washington State exemption remains at $2 million.

President Elect Obama pledged to keep it at the $3.5 million level during the election, but with all of the politics surrounding the estate tax, nothing is certain. There are a lot of commentators asking if a President Obama will be able to follow through with all of his proposed tax cuts. The “cost” of his proposed tax cuts would be $2.9 trillion over 10 years. It is also likely that he will not be able to offset his tax cuts with tax increases next year due to the need to stimulate the economy. Taken as a whole the changes proposed during the campaign would substantially shift the tax burden.

We are now one week after the election. Speculation on the changes our new president will propose and ultimately get passed are everywhere. The article from Kiplinger’s is the first I have seen on the subject of the estate tax that seems to be coming from an inside source.
